DMCA Takedown & Counter-Notice Procedure

1. Designated agent under 17 USC §512(c)

Pathshala has designated the following agent to receive notifications of claimed infringement on the Pathshala OS service and the Pathshala marketing sites:

2. Filing a takedown notice

To be effective under 17 USC §512(c)(3), your notice must include:

  1. A physical or electronic signature of a person authorised to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works at a single site, a representative list).
  3. Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to let us locate it — ideally a direct URL.
  4. Information reasonably sufficient to let us contact you: address, telephone number, and email.
  5. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are the owner, or are authorised to act on behalf of the owner, of the exclusive right that is allegedly infringed.

Send the notice to the agent above. Email is the fastest channel.

3. What happens after you file a notice

  • We will acknowledge receipt within two (2) business days.
  • If the notice is facially valid, we will expeditiously remove or disable access to the identified material.
  • We will take reasonable steps to notify the User who uploaded the material, including forwarding the notice (with your contact details redacted only at our discretion and only where permitted by law).
  • We may, in our discretion and where permitted by law, publish a transparency note about the takedown.

4. Counter-notice

If you are a User whose material was taken down and you believe in good faith that the takedown was a mistake or misidentification, you may submit a counter-notice. To be effective under 17 USC §512(g)(3), it must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. District Court for the Eastern District of Virginia (or, if your address is outside the United States, for any judicial district in which Pathshala may be found), and that you will accept service of process from the person who provided the original notice or that person's agent.

Send the counter-notice to legal@pathshala.co. If we receive a valid counter-notice, we will forward it to the original complainant. Unless that complainant files a court action seeking a restraining order within 10 business days, we may restore the removed material between 10 and 14 business days after we receive the counter-notice.

5. Repeat-infringer policy

Pathshala maintains and reasonably implements a policy of terminating, in appropriate circumstances, the accounts of Users who are repeat copyright infringers. Counts of strikes are kept under our Acceptable Use Policy.

6. Misuse of this process

17 USC §512(f) provides that anyone who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, is liable for damages. Do not use the DMCA process to silence criticism, remove competing content, or harass other Users.
